THE CONFRONTATION OF COMMON-LAW AND CHANCERY JUDICIAL JURISDICTION IN ENGLAND THE EARLY XVII CENTURY ON THE EXAMPLE OF THE “COURTNEY V. GLANVILL” CASE

Abstract

In the paper the case of “Courtney v. Glanvill” 1616, which demonstrates escalation of jurisdictional conflict between common law courts and the Chancellery court, is considered. This confrontation has had a significant impact on subsequent development of the law of England.
