КОНСТИТУЦИОННОЕ ПРАВО В СИСТЕМЕ МЕЖДУНАРОДНОГО ПРАВА

Аннотация
В статье проанализированы процессы конституционализации международного права. Цель исследования – оценка их потенциала для становления конституционного международного права на основе проведенного анализа. Методологическая стратегия построена на синтезе общенаучных и специальных частноправовых методов. Основной акцент сделан на трех основных аспектах конституционализации международного права: общих ценностях международного сообщества, правотворческом процессе на глобальном уровне и субъектах международного права, рассмотренных сквозь призму теории суверенитета. Затронута проблема поиска методологии конституционного международного права. В заключении сделан вывод о необходимости выделения международного конституционного права в качестве независимого образования в рамках международного права ввиду однородности осуществляемого им правового регулирования.
